How do we use your personal data?

The Data Protection Act 2018, as supplemented by the General Data Protection Regulation (GDPR), describes how organizations — including Sound Devices, LLC— must collect, handle, and store personal information. These rules apply regardless of whether data is stored electronically, on paper, or on other materials. To comply with the law, personal information must be collected and used fairly, stored safely, and not disclosed unlawfully.

According to the law, Sound Devices, LLC can only use your personal data if we have a proper reason for doing so, such as:

  • To fulfill a contract we have with you (i.e. warranties and customer support)
  • If we have a legal duty to use your data for a particular reason
  • When you consent to its use
  • When it is in our legitimate interests

Countries take a different approach to the use by companies of legitimate interests as a reason for processing personal data. We are aware of those different approaches in the countries in which we operate. We take that into account and respect those differences when we process your personal data.

Except as is otherwise provided in this Privacy Policy, at no time is your personal data sold by Sound Devices, LLC to third parties, data brokers, advertisers, or data marketplaces.

Our reasons for using your personal data include:

  • To provide top-notch services to you
  • To provide the products and services you request

  • To personalize and improve your customer experience
  • To inform you about our news, firmware updates, and product offers that we think might interest you
  • To respond to complaints and to seek to resolve them
  • To test and improve our products and offerings
  • To manage how we work/partner with other companies that also provide goods and services to us and our customers
  • To run our business in an efficient and proper way
  • To fulfill our administrative purposes including accounting, billing and audit
  • To protect our business interests
  • To develop and manage our brands, products, and services

Our legitimate interests include:

  • Keeping our records up to date
  • Developing products and/or services and what we charge for them
  • Being efficient about how we fulfill our contracts, provide our services, and discharge our legal duties
  • Identifying ways to improve the way we deliver products and services to our customers
  • Identifying or defining types of customers for new products
How can you manage any marketing messages received from us?

You may elect to receive these messages by opting in on our communication preferences form, by checking the opt-in box when using a form on our Website, by requesting an opt-in through our support team, or by scanning your name tag at a trade show or event.

The opt-in checkbox will be displayed to you on our forms if you have not opted-in to our emails. If you decide you no longer want to receive our emails, you may opt-out at any time using one of the two methods below.

You may change your communication preferences at any time by:

  1. Using our communication preferences form. A link to the communication preferences form is provided at the bottom of our marketing emails.
  2. Sending your request to Sound Devices Customer Support at [email protected].
How long do we keep your data?

We keep your data until you contact us and tell us to modify or delete it from our servers or until we determine that maintaining your data is no longer necessary to provide you with our products and services, for our own legitimate interests (described above) or so that we can comply with the law. We will actively review the information we hold and when there is no longer a customer, legal or business need for us to hold it, we will either delete it securely or in some cases anonymize it.

How do we protect your data?

We protect your personal data against unauthorised access, unlawful use, accidental loss, corruption and destruction.

We use technical measures such as encryption and password protection to protect your data and the third-party systems in which they are held. We also use operational measures to protect the data—for example: by limiting the number of people who have access to the databases in which our registered users’ information is held.

We keep these security measures under review and refer to industry security standards to keep up to date with current best practices. However, since no method of Internet transmission is 100% secure, we cannot guarantee, ensure or warrant the security of any personal information you transmit to us.

How do we share and track your data?

Except as otherwise set forth in this Privacy Policy, at no time is your personal data sold by Sound Devices, LLC to third parties, data brokers, advertisers, or data marketplaces.

However, for specified reasons, we do share some of your personal data with, or obtain personal data from, the following categories of third parties:

Your credit and debit card information: In order to process payments and prevent and detect fraud, we process payment card data through our payment card and fraud management services providers.

Suppliers who provide marketing services to us: We sometimes share your data—with your consent— with other companies that provide marketing services. For example, if you have given us authorization to use information about (or images of) you and your gear in an online article and/or for promotional purposes, then that personal data may be shared with publishers of trade magazines, through online websites/services (i.e. YouTube), in marketing materials, and with the companies we use to approach you for marketing, research and feedback purposes as they relate to our product offerings and services.

Other third party service providers: We may also disclose your data to other third party service providers, including, but not limited to, resellers, distributors and common carriers to help us process orders, deliver products, and otherwise assist us in running our business.

Government authorities such as border control and law enforcement: We sometimes have to provide your personal data to government authorities, such as customs officials, to ensure that you receive product/services or to meet our legal and regulatory obligations.

Affiliates: We may share data or other information with our subsidiaries, divisions, and affiliates.

Where required or permitted by law, such as in conjunction with a subpoena, government inquiry, litigation, dispute resolution, or similar legal process, when we believe in good faith that disclosure is necessary to protect your rights, your safety, or the safety of others, to detect, investigate and prevent fraud, or to conduct screening to ensure you are not on any government list of restricted parties.

If the ownership of all or substantially all of our business changes or we otherwise transfer all or part of our assets relating to our business or the Website to a third-party, such as by merger, acquisition, bankruptcy proceeding, joint venture, partnership or otherwise, we may transfer or sell your personal data to the new owner. In such a case, unless you agree differently or unless otherwise permitted by applicable law, your information would remain subject to the terms and conditions set forth in this Privacy Policy.

Most web browsers and some mobile operating systems and mobile applications include a Do Not Track (DNT) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will update our policy related to such DNT signals in this Privacy Policy.
